Bunnings, the hardware giant, has been given the green light to use facial recognition technology on customers to combat crime, sparking a heated debate on privacy and security. The Administrative Review Tribunal reversed a 2024 ruling by the Australian Privacy Commissioner, finding that Bunnings had breached privacy by scanning and checking faces without proper notification. However, the tribunal agreed that the technology was justified for a limited purpose: preventing significant retail crime and protecting staff and customers from violence, abuse, and intimidation. Bunnings deployed facial recognition in 62 stores in New South Wales and Victoria, scanning hundreds of thousands of people's faces against a database of banned individuals. While the technology generated false positives, which were manually reviewed and discarded, it was deemed effective in identifying repeat offenders and organized criminals. Bunnings' national security manager, Alexander MacDonald, highlighted the high success rate of investigations, attributing most theft losses to a small percentage of offenders. The tribunal acknowledged the potential bias in facial recognition, but Bunnings' system showed no racial bias. Despite the ruling, the Office of the Australian Information Commissioner (OAIC) has not ruled out appealing, emphasizing the need for strict privacy protections. Bunnings' managing director, Mike Schneider, welcomed the ruling, emphasizing the company's commitment to safety and customer protection. The controversy lies in the balance between security and privacy, leaving many questioning the boundaries of acceptable surveillance.
